Senior Counsel

This is a hybrid position requiring 3 days in office at either our Hartford, CT, Chicago, IL or Middleton, WI office location.

CapSpecialty is seeking a Senior Counsel who, under the guidance of the General Counsel, will act as in-house corporate counsel, be responsible for providing legal advice to support the Company on a variety of legal, regulatory, compliance, and insurance issues.  As designated by the General Counsel, the Senior Counsel will be responsible for all aspects of product drafting and/or all aspects of coverage analysis, coverage litigation and extracontractual or bad faith matters. This position is also responsible for providing strategic and technical guidance and oversight to the Company on policy wordings and coverage matters, including determinations of when outside counsel is necessary. There may also be opportunities to collaborate on brief writing and other strategic matters on behalf of the Company.

 

Duties/Responsibilities:

  • Researching, analyzing and advising business units and corporate functions on applicable laws and regulations on a variety of regulatory, compliance, insurance and corporate issues.
  • Working with key business stakeholders across CapSpecialty on key projects and initiatives.
  • Staying abreast of legal and regulatory developments relevant to the business of insurance and CapSpecialty's products and services.
  • Drafting corporate policies, procedures and training materials.
  • Drafting policy wordings, endorsements and other policy-related documents, and supporting the underwriters across all lines of business written by CapSpecialty; including responding to day-to-day manuscript endorsement requests from underwriters in all of CapSpecialty's offices and across all lines of business.
  • Communicating with the various internal and external stakeholders on policy language and providing strategic recommendations with respect to coverage issues and coverage litigation.
  • Working with claims management on strategic coverage decisions, including researching, investigating and analyzing coverage issues on specifically identified claims including preparing appropriate coverage opinions and coverage correspondence.
  • Overseeing certain corporate and coverage litigation, including directing and supervising outside counsel and managing loss costs (loss, ALAE and ULAE) on assigned files.
  • Participating in product development, large loss discussions and special projects or other tasks as directed.
  • Providing assistance, analysis, guidance, and direction to department staff, other departments, customers, attorneys, and others as requested or as assigned.
  • Providing guidance and training to the Company, including the claims staff, on specific claims as well as thought leadership on trends and emerging issues related to coverage, bad faith, and extra contractual insurance law.
  • Performing other duties as requested by the General Counsel.

Supervisory Responsibilities:

None.

Education and Experience:

  • Bachelor's Degree, Juris Doctorate and admitted to a state bar. 
  • 5+ years in an insurance company, preferably property/casualty, or law-firm in an insurance-related practice. Claims and coverage experience is relevant.

Physical Demands:

  • Prolonged periods of sitting at a desk and working on a computer.
  • May be required to lift up to 15 lbs at times.
  • May require occasional travel to office locations in other states.
